Terms & Condition of Sales (Terms) : Online Store

1. Publisher and Scope

These Terms and Conditions of Sale (Terms) govern all sales made on the websitehttps://www.elledicreative.studioto individual consumers (B2C) or commercial entities (B2B).

The seller is ElleDi Creative SAS, with a share capital of €1000 registered with the Paris RCS under number 993830132, located at 61 rue de la République, 75012 Paris, France (Email: legal@elledicreative.studio).

Placing an order on the site implies full acceptance of these Terms.

2. Products and Services

ElleDi Creative offers on its online store:

  1. Art Books and Publications: Fulfilled and shipped by our logistics partner Octopia.
  2. Fine Art Photographic Prints: Printed, mounted, and custom-made according to the client's selected specifications (size, paper, framing) by our laboratory partner WhiteWall.
  3. Event Tickets: Ticketing for scheduled vernissages, exhibitions, readings, or workshops.

3. Pricing and Payment

  • Pricing: Prices are indicated in Euros (€) inclusive of VAT for B2C sales, and exclusive/inclusive of applicable taxes for B2B. Shipping costs are calculated and displayed prior to final order confirmation.
  • Payment: Payment is due immediately upon ordering and processed securely via Shopify Payments (credit card, Apple Pay, etc.).

4. Right of Withdrawal (Cancellation Policy)

A. Exclusion of Withdrawal Right (Fine Art Prints & Event Tickets)

In accordance with Article L.221-28 of the French Consumer Code:

  • Custom Fine Art Prints: The right of withdrawal does not apply to goods made to consumer specifications or clearly personalized (custom printing and framing produced on demand by WhiteWall). Returns or cancellations are not accepted once production has begun.
  • Event & Workshop Tickets: The right of withdrawal does not apply to leisure services provided on a specific date or period. Tickets are non-refundable and non-exchangeable.

B. Applicable Right of Withdrawal (Books - B2C Consumers Only)

For books purchased by individual consumers (B2C), the client has a 14-day statutory period from receipt of goods to exercise their right of withdrawal. Returned books must be in original, brand-new condition. Return shipping fees are borne by the client.

5. Delivery, Inspection, and Warranties

A. Shipping and Delivery

Orders are shipped to the address provided at checkout via our partners' logistics networks: Octopia (books) and WhiteWall (fine art prints).

B. Package Inspection & Transport Damage

The client must inspect the packaging and goods upon delivery:

  • If a package is visibly damaged, crushed, or opened, the client must write clear and explicit reservations on the carrier's delivery slip (e.g., "Parcel damaged, artwork bent"), or refuse delivery.
  • The client must notify ElleDi Creative via email (legal@elledicreative.studio) within 48 hours with photos of the damaged packaging and product. Failure to do so will void damage claims and replacement coverage with our production partners (WhiteWall / Octopia).

C. Legal Warranties

For B2C buyers, products are backed by the French statutory warranty of conformity and warranty against hidden defects.

6. Applicable Law and Jurisdiction

These Terms are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the courts of Paris, France.
